These Terms of Service ("Terms") govern your access to and use of the websites, services, and deliverables provided by Dune ("Dune", "we", "us", or "our"). By requesting a demo, placing an order, or using our services, you ("you" or the "Client") agree to these Terms.

1. Our services

Dune provides digital services for local businesses, which may include the design and build of a website, setup of online presence and Google visibility, management of paid advertising campaigns (such as Google Ads and Meta Ads), and ongoing website care (hosting, updates, and edits). The specific services in your engagement are those described in your order or quote.

2. Demos, quotes and orders

We may prepare a free preview ("demo") of a proposed website at no cost and with no obligation. Pricing is tailored to each business and is provided as a written quote. An order is formed when you accept a quote and confirm you wish to proceed. All prices are stated exclusive of any applicable taxes unless otherwise noted.

3. Payment

Fees, deposits, and any recurring charges (for example, a monthly care plan or advertising management) are set out in your quote. One-time build fees are due as stated in the quote. Recurring services are billed on a repeating basis until cancelled in accordance with these Terms. Payments are processed by our third-party payment provider; by paying, you also agree to that provider's terms.

5. Intellectual property

Upon full payment for a website build, you own the final delivered website content and design created specifically for you. Dune retains ownership of its underlying tools, templates, code frameworks, and know-how, and of any pre-existing or third-party materials (including stock assets and fonts, which remain subject to their own licences). We may reference your business and display the work in our portfolio unless you ask us in writing not to.

6. Third-party services

Our services rely on third-party platforms (such as hosting, Google, and Meta). We are not responsible for those platforms' availability, policies, pricing, or decisions, including ad approvals or account actions taken by them.

7. Warranties and disclaimer

We provide our services with reasonable skill and care. Except as expressly stated, the services are provided "as is". We do not guarantee specific results, rankings, traffic, leads, sales, or advertising outcomes, as these depend on many factors outside our control.

8. Limitation of liability

To the maximum extent permitted by law, Dune will not be liable for indirect, incidental, or consequential losses, or for loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the services will not exceed the amount you paid to us for the services giving rise to the claim.

9. Cancellation and termination

You may cancel a recurring service (such as a care plan or ad management) at any time; cancellation takes effect at the end of the current billing period. Refund eligibility for one-time work is set out in our Refund Policy. We may suspend or terminate services for non-payment or breach of these Terms.

10. Changes

We may update these Terms from time to time. The current version is always available on this page, and the "last updated" date shows when it last changed. Continued use of our services after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Dune is established, without regard to conflict-of-laws rules.
